The Ethical Code of Conduct and how to remain compliant. Essential for every business with the introduction of the UK Bribery Act.

The UK Bribery Act 2010 came into force on 1 July 2011. It amends and reforms the UK criminal law and provides a modern legal framework to combat bribery in the UK and internationally. According to the Foreign and Commonwealth Office:

"The Bribery Act 2010, attracted strong cross party support in Parliament and received Royal Assent on 8 April 2010. Section 9 of the Act requires the Government to publish guidance on procedures that commercial organisations can put in place to prevent bribery on their behalf. Foreign bribery has been illegal for many years, with a number of individuals and companies having been convicted under the current law. The UK is contributing through the OECD Working Group on Bribery International Business Transactions and the UN Convention Against Corruption to increasing global awareness, enforcement and investigation of foreign bribery."

E-learning for Employees

EssentialSkillz (a leading supplier of world-class online Health & Safety training and risk assessment software) offer a short course on Anti-Bribery and Corruption to ensure your employees and anyone who works on your behalf is aware of the new UK Bribery Act coming into force July 1st. The e-Learning course demonstrates how it can affect employees and how it impacts on current work practices.

Are you confident that your organisation has adequate procedures in place to address the recent guidance?

One of the main areas of interest to organisations under the UK Bribery Act is the creation of the new strict liability criminal corporate offence of failing to prevent bribery by a person associated with it, including employees, agents, and intermediaries. In order to establish a defence to charges under the Act, organisations must be able to demonstrate they had adequate anti-bribery procedures in place. Adequate procedures should address the key six principles stated in the recent guidance issued by the U.K. Ministry of Defence. These principles are:

  1. Proportionality - procedures should be 'proportionate' to the nature, scale and complexity of an organisation's activities.
  2. Top-level commitment - senior management and the board should oversee policies and implementation.
  3. Risk assessment - organisations should review and monitor the bribery risks they face.
  4. Due diligence - organisations are liable for acts of bribery committed on their behalf, whether they had knowledge or not. Organisations should conduct due diligence on all to ensure bribery is prevented.
  5. Communication and training - Anti-bribery policies and procedures should be communicated to all who work on the organisation's behalf.
  6. Monitor and review - Organisations should show that they regularly monitor and review the adequacy of policies and adapt as required.

This course communicates an organisation's Code of Conduct and Anti-bribery procedures and facilitates an organisation's implementation of the above six principles.

Who will benefit from anti-bribery and corruption training?

All employees, agents, sub-contractors, subsidiaries: basically anyone who carries out work on behalf of your organisation. In this training course employees will learn all about the new bribery offences, the penalties involved if convicted of bribery offences, the general standards of behaviour expected by the organisation with regard to areas of concern such as insider dealing, facilitation payments and conflicts of interest. In addition, training will be given on your organisation's policy with regard to what is viewed as acceptable when giving or receiving offers of gifts and hospitality, plus details on the obligation to report issues of concern and confirmation of the procedures available.
